Court rules that strike by British Airways cabin crew isn’t legal

Posted on December 17th, 2009

Passengers flying from Newcastle Airport over the festive period will be relieved after a High Court ruling that the union UNITE did not properly ballot it’s members therefore declaring that the strike called over the Christmas period is not legal. While British Airways are obviously pleased at this ruling it also means passengers planning to travel with British Airways from Newcastle Airport will be equally pleased after flights were threatened with cancellation.

The ballot was invalid because UNITE had balloted members who had already accepted voluntary redundancy from British Airways which makes them illegible to vote to strike. The judge, Mrs Justice Cox, said “A strike of this kind over the 12 days of Christmas is fundamentally more damaging to BA and the wider public than a strike taking place at almost any other time of the year.”
